“University is a learning experience, it’s okay to fail.”

These words that are intended to comfort me echo through my mind at every instance of academic hardship. University is often advertised as a place for learning and self-discovery, but this narrative often only applies to privileged, higher-income students. As an immigrant student from a low-income background and challenges with mental health, I’ve always been perplexed as to how this wasn’t just a privileged oversimplification of the emotional, physical, and financial burdens that often accompany enrollment in university for students of lower income. After all, when students who are well-off fail courses or decide to pursue additional years of education, their families can often support that decision financially. On the contrary, a student struggling similarly with their education would not have that support to fall back on. With little support, low-income students must navigate an education system designed for students without such pressures and financial difficulties, and are thrown into a cycle where there is seemingly no escape.

Even with the Ontario Student Assistance Plan, numerous low-income families struggle to meet the yearly cost of university to invest in their future. OSAP is unforgiving of students who, often for valid reason, fall below their academic standing requirements. OSAP-assisted students often face familial, personal or financial challenges, which can manifest as academic hardship, since students lose the capacity or time to devote to their studies. Rather than supporting students in such extenuating circumstances, the institution punishes them through academic probation and OSAP reductions or cuts. What implication does this have on the well-being of low-income students, who are pressured to excel in university and graduate as soon as possible, only to be thrown into an increasingly competitive job market? While their debt accumulates and while finding employment post-undergraduate becomes increasingly difficult, the pressure to graduate quickly heightens.

As much as I desperately want to advocate that it’s okay to fail and learn from our mistakes, I have experienced whirlwinds of anxiety in thinking that my mental health might set me back a year to prolong my education or increase my loans and costs.

As a result, any effort to keep my grades sufficiently “competitive” came at the cost of my well-being. Despite this, I could not succumb to the exhaustion and anxiety because the consequences of performing poorly in school would be too great to bear. Institutionally, we are thrown into a cycle where we fall thousands of dollars in debt in hopes of finding a job, yet our education may become jeopardized while we try to stay afloat. Low-income students often also work part-time to help pay fees, but the time commitment comes at the cost of their education; students are locked into positions where their ability to meet standards of academic performance is hindered. Paradoxically, we may come out of university even more financially burdened than when we started, and must find a way out. This is a challenge that higher income students usually do not have to consider seriously, often allowing many of them to enjoy and excel in their education with little financial burden.

I cannot advocate that our grades don’t define us without acknowledging my hypocrisy when I criticize myself for falling short. We’re given little guidance on what to do with failure and how to succeed despite it; The only students who share their marks are “straight A” students; the only students who share their work experience share what positions accepted them, rather than what rejected them. The perspective skews towards one of communal success, while students who are struggling are left on the sidelines.

While individuals can seek support services, like by taking loans or seeking therapy (which is also paradoxically expensive), the solution needs to target the system. Changes in the university structure, financial aid, student support and a greater focus on permitting work-life balance may provide us with stepping stones, but these inherent inequities that lead to disparities in students’ well-being and success need to be addressed by institutions, the Ontario Student Assistance Plan and students benefiting from this systemic privilege.

I’m sick of falling prey to this system. For once, I want to be able to say, “It’s okay if we fail, we can learn from this,” and truly, genuinely mean it.

Jackson Tarlin, a Level V Engineering Physics student at McMaster, has presented a wide-ranging platform that aims to address a range of issues affecting students.

“Our goal is to take every annoyance you’ve grumbled about during your time at McMaster and throw them in the trash. Then set the trash on fire. If we have time left over once we’re done, we’ll use the trash fire to light our pipe and then sit in a muskoka chair and watch the sunset,” the platform overview states.

Tarlin built his platform upon four pillars: Student Life, Clubs and Services, Campus and the Environment. 

Student Life 

Tarlin’s platform approaches student life with a focus on personal expression, McMaster Student Absence Form extensions, hydration, affordability and accessibility. 

Beginning with personal expression, Tarlin aims to address conflicts between personal expression and a need to maintain illusions of harmony on important issues. He would assign zones to different parts of campus, with each one corresponding to a distinct and permissible level of personal expression. Tarlin’s five zones range from Zone 1, which prohibits politics and foul words, to Zone 5, which restricts conversation to swearing and screaming only, prohibiting compassion. 

With regards to the MSAF policy, he proposes changing the current allowance period, which currently allows up to three consecutive days of missed work, to allowing up to two months of MSAF use. Tarlin states that this would increase stress during exam time and reduce student retention. 

Hydration has its own place in Tarlin’s platform. He plans to shame individual water fountains by putting up a bulletin board dedicated to criticizing the worst water fountains across campus. He believes this will encourage water fountains, although they are inanimate, to better themselves. 

Tarlin proposes the replacement of all stairs on campus with ramps. He hopes that the amount of construction required would facilitate a familiar and comfortable ambience for McMaster students. 

“It just wouldn’t be McMaster without [all the noise and construction],” Tarlin’s platform explains. 

Clubs and Services 

Tarlin’s second pillar focuses on The Silhouette, Spotted at Mac and McMaster Confessions. He suggests increasing the tuition of 20 students by $15,000 to hire full-time journalists for The Silhouette and allow the newspaper to release issues every day. 

Tarlin’s proposal to give full club status to Spotted at Mac and McMaster Confessions is something he hopes will increase their reach with their respective audiences. Both of these Facebook pages are known for publishing anonymous posts from Mac students.

Campus 

Tarlin sees opportunities to change campus in five ways: moving the A.N. Bourns Science Building to Parking Lot I to make Thode more accessible from the John Hodgins Engineering building, replacing a tree near Togo Salmon Hall with a “better tree” and building a monorail between the McMaster University Student Centre and Mills Library.

Due to the very small distance between MUSC and Mills, the monorail would not need to move. Tarlin believes that the costs of constructing the monorail would be saved by the absence of electricity costs needed to run the monorail. 

The Environment

Tarlin dedicates the rest of his platform to the environment. He encourages more animal safety awareness in order to stop students from eating cockroaches at Centro. As a tribute to modern music, he wants to rename Cootes Paradise, “Gangsta’s Paradise”. He also points out the moderate nature of geese at McMaster; he believes they could be trained to be as violent as geese from universities such as Waterloo and University of Toronto. 

Lastly, Tarlin’s platform delivers one ultimate goal: to solve climate change once and for all.

Top 5 things to look forward to in the new year in McMaster Athletics

1. Nordic Skiing

Possibly one of the more interesting stories of the year is the addition of the Nordic Skiing Program to McMaster Athletics’ arsenal of contenders for the Ontario University Athletics championship. This will be the 37th program brought to competition by McMaster and nordic skiing will have a new provincial championship introduced in February 2020. With the introduction of this program, McMaster Athletics is looking to the future and the expansion of its trophy case. It was a bold move to introduce a new sport while the David Braley Athletic centre is undergoing expansion, but McMaster Athletics has shown that they are not letting any physical barriers in facilities, or lack of snow this year, to stop them from progressing.

2. Volleyball

The Men’s Volleyball team is coming off a busy winter break. They faced top-notch competition from several teams in the United States including Ohio State University, Long Beach State University and Lewis State University. Even though they lost to their American competitors, squaring off against fierce competition will help them improve their game as they enter 2020. On the Northern side of things, McMaster took down National Championship contender Trinity Western University two days in a row. These two wins against a Canadian powerhouse is great news for the Marauders and casts the rest of the season in a bright light.

The Women’s volleyball squad is looking for another shot at a playoffs run. After falling short in the 2018-2019 season and missing the playoffs, the Marauders are looking for redemption. Currently ranked fourth in the Western division of the OUA, the race to make playoffs will come down to the wire as three teams have already clinched their berths, leaving only one spot available. On a positive note to start the second half of the season was the two blow out wins the Marauders pulled off against the Lakehead University Thunderwolves. This is a great start to January as the Women’s team gears up to play the Ryerson University Rams, who are ranked first in the OUA east, and the Brock University Badgers, ranked third in the OUA west, later this month. 

3. Basketball

The Women’s team is looking to defend their National Championship as they gear up for a tough second half of the season. They just lost to the fifth overall team in the nation according to U sports, in the Ryerson University Rams, the Marauders look to take down other strong contender in the Western University Mustangs and Windsor University Lancers. These games will test the Marauders during this cold January streak. 

The Rams have a sharpshooting starting lineup, and they averaged 46.5 per cent from the field in the matchup against the Marauders. The Rams’ recruiting program has led to a decade of success, where exceptional shooting has consistently remained one of the team’s strengths. That being said, the main issues for McMaster was that they were outrebounded 51 to 30 and had five more turnovers than the Rams. Cleaning up these two areas could lead to far fewer issues in the future.

U Sports ranks the McMaster Men’s Basketball team eighth overall in the country. Currently sitting in playoff contention with a record of nine wins and three losses, they look to stay strong and head to the playoffs again this year. That being said, they have a hard January in front of them, where they will be playing many top schools including the Windsor University Lancers, Western University Mustangs, Queens University Gaels and the Ryerson University Rams, with one easier matchup against Ontario Tech. Queens, Windsor, Western and Ryerson are top teams in the OUA who are looking for something to prove. In order to get by these opponents, the Marauders will have to stay consistent throughout every quarter, something they were not able to do in the last matchup against Ryerson. While the Marauders are staying strong with low turnover rates combined with a high number of takeaways, they need to clean up shot selection to make sure they stay on the high scoring streaks they are known for.

4. Expansion

In case you haven’t noticed, David Braley Athletic Centre is under expansion! The renovations mark just one of many additions to accommodate for the ever-growing student body of McMaster. DBAC’s expansion is set to create more exercise space and athletic opportunities in order to allow a greater number of students to use the facilities. If you have travelled into the depths of DBAC and the Ivor Wynne Center, then you are familiar with the out-of-date, overrun and sometimes run-down squash, basketball and Pop-up Pulse. The construction, which started this year, meant  to create a happier, healthier and more active campus.

5. Championships

The athletic year is only halfway through, and surely you remember the Yates Cup stunner, but there are so many tournaments left in the year for you to enjoy! The OUA is a vast and expansive association covering more sports than you can probably name, which means there is no shortage of exciting championships to come in 2020. Some of my favourites that you should keep an eye out for include the Critelli and Wilson Cup, both taking place on Feb. 29. The Critelli Cup, the women’s basketball championship, is looking like it will be another exciting year with many top programs performing at a high level. The path to the Wilson Cup, which is awarded to the OUA men’s basketball championship winner, is looking like it could be exciting. With several underdog contenders putting up a fight in the regular season, the cup is up for grabs to whoever wants it most. Get ready for the madness of Cup season — who knows who will be the Cinderella story this year.

It was my second year of university and I was finding it increasingly difficult to keep up with my studies because I was having traumatic flashbacks every day and night terrors every night. I was seeing a counsellor and a doctor to address my poor health. Despite this, my marks continued to slip.

Luckily, I was able to register with Student Accessibility Services when I realized I needed some extra help with school. This lifted a lot of weight from my shoulders, as I was able to access lecture notes through the SAS website and spread out my tests over a longer period of time. However, it wasn’t smooth sailing from there. 

One of my accommodations under SAS is for instructors to provide an alternative to missed classwork. Knowing this, when I was unable to write a midterm due to my disability, I emailed the instructor to let them know. 

In their reply to my email, I was told, “We do not offer an alternate date to write the midterm. If you are unable to write the midterm today, you will need to use a [McMaster Student Absence Form]. Using an MSAF will move the weight of the midterm to the final exam making the final worth a total of 94%.” 

Despite having SAS accommodations, I was rejected of the accommodations that were supposed to help level the playing ground when it came to succeeding in courses. I remember being upset and frustrated because I’ve always had the impression that educators should be focused on helping their students succeed. Because of my instructor’s response, this situation dragged out for over a month as my assistant dean had to talk to the instructor to advocate for me. Meanwhile, I was constantly studying for a midterm whose date was unknown to me. Since I was having difficulties rescheduling my midterm, I fell behind in class and ended up dropping the course.

According to the Ontario Human Rights Commission, educators must accommodate their disabled students. Furthermore, accommodations should be unique and individualized — meaning, “blanket” accommodations that are meant to cover all disabilities often don’t work because disabled students have different needs. Educators should be cognizant that an accommodation, which may seem helpful in their eyes, may not actually be helpful for a student. As a result, they could be putting undue stress on the student who needs the accommodation.

Saying that I can use an MSAF to redistribute the weight of my midterm is not an accommodation. I don’t know about you, but having a 96 per cent exam doesn’t exactly exemplify a good ‘accommodation’. In fact, I’d argue that most non-disabled students would find a 96 per cent exam overwhelming. Maybe someone else might be okay with this accommodation, but it just wasn’t going to work for me. And that’s okay.

The unfortunate thing is that even with SAS, I still faced many barriers in receiving adequate accommodations. However, many disabled students go through their undergraduate career without SAS because registering can be a long process. For example, SAS registration requires medical documentation from a doctor, meaning that a formal diagnosis is necessary even though many conditions can be difficult to diagnose or may be highly stigmatized, which may result in the lack of diagnosis. 

The unfortunate thing is that even with SAS, I still faced many barriers in receiving adequate accommodations. However, many disabled students go through their undergraduate career without SAS because registering can be a long process. For example, SAS registration requires medical documentation from a doctor, meaning that a formal diagnosis is necessary even though many conditions can be difficult to diagnose or may be highly stigmatized, which may result in the lack of diagnosis. 

Instead of focusing on formal diagnoses, instructors should concentrate on providing support to students who need it. Evidently, there can be many complications that prevent someone from receiving disability status at McMaster. As a result, disabled students can fall behind in their coursework just because they cannot provide an accommodation letter from SAS to their instructors.

Even when you do have SAS, advocating for your accommodations can be taxing. Meeting up with your professors to discuss accommodations can make you feel vulnerable. Emailing professors every time you’re absent from class and having to reschedule several midterms after a flare-up can be exhausting. 

Even after all of this, you may still face resistance regarding your accommodations. I have faced the risk of my SAS accommodations expiring even though my disability is permanent. As a result, I had to get medical documentation again to verify that my disability wasn’t going away anytime soon. I’m not the only person who has faced this problem — I’ve heard from many peers that they’ve faced a similar situation where their SAS status expired and they were unable to access accommodations when they needed them most.

The accommodation process is made more complicated by negative perceptions that students who ask for course accommodations are “cheating the system.” Of course, there’s always the possibility that there will be a student who asked for an accommodation they don’t actually need. But, more often than not, it’s because they really need it. A student’s SAS status shouldn’t be the only reason why an instructor should provide course accommodations. If students are reaching out to you about how they might need some extra help in class, consider giving them the support they need to succeed in your course.

Often times, accommodations can be easy to arrange. Providing a student with notes, lecture slides or an extension for an assignment doesn’t usually require extra effort on the instructor’s behalf. However, it’s important to note that even if the accommodation isn’t ‘“convenient’” to provide to a student, they still deserve to be adequately accommodated. To ensure that accommodations are properly handled, there should be a clearer follow-up process of accommodations within each faculty. Students should know who to go to when something isn’t properly handled, as well as be able to access support from their faculty during this process.

Because at the end of the day, educators should be concerned about a student’s success — not their disability status.

Each year of university can feel like a new beginning, culminating in a gruelling session of final exams. Final exams are customarily used to test students’ comprehension of course material over the course of the semester. However, many students study for exams by cramming as much information as they can the week, or sometimes even the night before the final. This trend has birthed what is commonly dubbed ‘exam culture’. Habits such as pulling all-nighters and drinking excessive amounts of caffeine are shared on social media and amongst friends, sometimes in an attempt to justify these unhealthy behaviours. Promoting these behaviours amongst peers and friends by sharing your poor habits can cause students to believe that these practices are acceptable, or even commendable.

The realistic approach to approaching education, on social media and otherwise, is to understand the repercussions of these exam habits. Rather than shaming friends and followers across Instagram or Twitter, I opt to lead by example. Refusing to contribute or engage with this type of behaviour on the internet may dissuade friends from posting these habits online due to lack of engagement. Also, encouraging positive habits will hopefully have the same impact by influencing others to adopt improved means of coping during exam season.

After I finished my first year, I learned how to study for exams in a way that was not detrimental to my mental or physical well-being. Students are often overwhelmingly stressed during exam season, as due dates for final papers, projects and exams approach. This can lead to issues such as insomnia, anxiety and lower sleep quality. The stress felt during exam season can lead to poor sleep quality and push students to consume excessive amounts of caffeine.

It is easy to see that these habits that are built over the years of undergrad, or even high school, often translate into normalized behaviours that negatively impact both physical and mental health. I believe one of the biggest problems that students face today is that these poor habits are being shared across various social media platforms in an attempt to normalize them. Sharing your unhealthy habits can encourage others to follow these behaviours, which is harmful.

It is easy to see that these habits that are built over the years of undergrad, or even high school, often translate into normalized behaviours that negatively impact both physical and mental health.

Often, I see students compete on social media about who stays up the latest, who drinks the most caffeine or who buys the most snacks. When these mindsets are shared online, they become accessible and may incite a trend, leading others to partake or post similar photos or videos. Along with this, it has become increasingly common to see students indulging in unhealthy foods, easily accessible via UberEats or other delivery methods.

This can be dangerous, especially during exam season when these poor habits often are used as distractions from studying and can lead to a mentally and physically vulnerable state.

Overall, exam season is a time when students are most at risk in terms of their health. Rather than normalizing poor behaviours by posting about your unhealthy habits online, it is more beneficial for these behaviours surrounding studying to be called out and given direction. If we all begin to conform and assimilate to “exam culture,” it will simply lead to more harm for students.

During the upcoming semester, it is essential to address and confront negative habits that cause more harm than good. It is also imperative to understand personal limits, rather than conform to the habits of the crowd. Through knowing and understanding individual capacities, poor habits can be substituted for more healthy ones. Investing time in discovering new and improved coping strategies for stress management may encourage students to prioritize their health alongside studies and education.

 The Sept. 22 deratification of the McMaster Chinese Students and Scholars Association has been a frequent topic in the Student Representative Assembly and the Silhouette for the past few weeks, and an issue that the SRA has been aware of since the inciting incident occurred back in February 2019. Since then, there have been many miscommunications about the de-ratification process and what was going on as a whole with the club to the student body, which I would like to clarify. 

The current SRA members for the 2019-2020 year took office in April. I was unaware of the actions of the previous SRA with respect to the Mac CSSA incident because, at the time, I had not been very involved. In July, when it came time to ratify clubs for the 2019-2020 school year in July, I was given the impression that Mac CSSA was to be under probation for a calendar year due to the February incident upon ratification for the 2019-2020 year. Evidently, this had not been true. As there is no transition process between outgoing SRA members and incoming SRA members, and along with internal miscommunication, this caused previous meeting events to be misunderstood.

In the weeks leading up to the Sept. 22 meeting, where Mac CSSA was de-ratified, I met with McMaster students, who had contacted me to ask about what was going on with Mac CSSA and if the MSU or SRA would be taking action. Other SRA members were also contacted by their constituents, leading to an investigation and eventually de-ratification. You can find evidence from these personal investigations in SRA documents from meeting 19H, which include the meeting minutes and documents labelled CSSA. Many students I met with said that they felt unsafe as a result of Mac CSSA’s actions and concerned that they could not express their political or academic freedoms, especially in criticizing the Chinese government, without repercussions for the students I spoke to or their families.

Some people have subsequently spoken out against the de-ratification as the result of procedural unfairness or bias. I understand these concerns, as this process has been anything but clear. Please continue to hold the SRA and MSU accountable for our actions.

To clarify the procedural unfairness issues: the SRA did not disband Mac CSSA, but rather removed its status as an MSU club. Disbandment is a sanction, handed out to the club by the Clubs Executive Council so they may not operate as an MSU Club for a calendar year. The SRA then makes the decision official. Instead of disbandment, the SRA de-ratified Mac CSSA in July,  rescinding its recognition as an MSU club. This meant that while Mac CSSA could still operate, the MSU would not allow them access to clubs resources such as funding and room booking. This difference between disbandment and de-ratification is important, as the latter process removes MSU club status through SRA motions, and does not go through the CEC. As such, the SRA is not required to grant an appeal period, as no appeal process exists for the SRA. However, one was granted anyways. In good faith, Mac CSSA should have received a notice that their de-ratification motion was on the upcoming agenda, despite not technically being required. In my opinion, the fact that Mac CSSA was not notified seemed to be due to a lack of communication. This needs to be changed, and the SRA’s clubs policy review, which will encompass the CEC, will include these concerns.

As for the bias concerns, these I can only address as myself. My reason for voting in favour of de-ratification was due to Mac CSSA’s support of the decision to report Rukiye Turdush’s Feb. 11 talk, which was about the Uyghur concentration camps in China, to the Chinese consulate. Disagreeing with the event is Mac CSSA’s right, but the endangerment of students, and Rukiye Turdush, is unacceptable. The SRA had also previously acted with the safety of students in mind during meeting 19F, when the Dominion Society (formerly the MacDonald Society) was de-ratified for the potential to endanger students after the SRA received evidence that linked the club to white supremacists. 

While Mac CSSA claimed that the previous president had acted alone in reporting the event to the consulate, they did not rescind their statement. In addition, in the Mac CSSA ratification status memo posted by the MSU, it is mentioned that McMaster Chinese News Network, McMaster Chinese Professional Association/Society and MELD Student Association “have stated in their June responses to SRA questions that a [former] Mac CSSA executive officer invited them to be signatories of the statement”.  During the appeal process, when Mac CSSA’s legal counsel was asked to provide evidence to support their statement that the previous president acted alone and did not contact the consulate, the counsel did not provide a clear answer to the the question in the SRA Meeting 19K livestream at the 1:40:30 mark.

The risk of endangering others for exercising their right to expression, especially those of marginalized groups, should not exist on this campus. Students who wish to engage in academic or political thought opposing the Chinese government, especially Chinese international students, should not be at risk. The evidence brought forward during SRA meetings highlighted how the Chinese government has monitored and interfered with students and citizens abroad, as seen in both U.S. government reports and international headlines, and as such I felt it was in the best interest of student and staff safety to remove the recognition of Mac CSSA as an official MSU club for a full calendar year.

Chinese international students should feel welcome and safe on our campus. Other groups that offer support for Chinese students are the Chinese Students Association, McMaster Chinese News Network and MELD Student Association. The SRA is doing an ongoing review of how international students are supported by the MSU and on campus as a whole. On Nov. 21, the Ontario Divisional Court struck down the Student Choice Initiative, a controversial directive introduced by the provincial government which required universities and colleges to allow students to opt-out of student fees deemed “non-essential.” Three judges unanimously ruled that the government did not have the legal authority to interfere with the autonomous and democratic decision-making process between universities and student unions. 

On Jan. 17, 2019, Ontario’s Ministry of Colleges and Universities publicly announced the SCI alongside a series of changes to post secondary funding, including cuts to the Ontario Student Assistance Program. When students were given the opportunity to opt-out in September 2019, services deemed non-essential such as food banks, student societies and campus media became vulnerable to funding cuts.   

On May 24, the Canadian Federation of Students-Ontario and the York Federation of Students launched a joint legal challenge against the provincial government’s SCI directive, claiming that the SCI was unlawful, proposed in bad faith and carried out in a way that was procedurally unfair. On the basis of the legality of the SCI, the Divisional Court of Ontario ruled in favour of CFS-O and YFS on Nov. 21.

The legal document explaining the judges’ decision cites previous Supreme Court rulings, which concluded that, while universities are regulated and funded by the government, “it by no means follows, however, that universities are organs of government … The fact is that each of the universities has its own governing body … The government thus has no legal power to control the universities even if it wished to do so.”

The Ontario government attempted to defend themselves by arguing that the SCI was a “core policy decision” not subject to judicial review, and that they were exercising their prerogative power over spending decisions. However, the Court’s legal documents state that, “with the exception of narrowly defined powers in the MTCU [Ministry of Training, Colleges and Universities] Act, policy-making and governance authority over a university is vested in its [university’s] Boards of Governors and Senates.”

 

THE DECISION

The Divisional Court found that by interfering with the agreement between student unions and universities, the SCI posed a threat to universities’ autonomy from the government.

Louis Century, an associate at Goldblatt Partners and lawyer for the CFS-O, sees the decision as proof of the importance of student unions.

“I would hope that student unions would read this decision as an affirmation of the central role that they play on campuses. That was a core part of the Court’s decision, is recognizing that . . .  they’re actually core to what happens on campuses at universities, so much so that the government overriding their affairs is overriding the autonomy of the university generally,” he said.

The YFS and CFS-O also argued that the government had implemented the SCI in bad faith, on the basis of a politically-motivated attack on student unions. While the Court heard this evidence, it did not end up being a factor in determining the legality of the SCI.

In a fundraising email sent to the Conservative party in February, Premier Doug Ford wrote, “Students were forced into unions and forced to pay for those unions. I think we all know what kind of crazy Marxist nonsense student unions get up to. So, we fixed that. Student union fees are now opt-in.”

Kayla Weiler, the National Executive Representative of the Canadian Federation of Students-Ontario, believes that the SCI was about silencing the organizations critical of the Ford government that advocate on behalf of students.

“This was never about choice. It was always about the Ford government trying to silence the exact bodies that hold them accountable and challenge them to do better,” Weiler stated during a press conference on Nov. 22.

Since its introduction, the SCI has been widely criticized. Student union representatives have argued that, while the purpose of the SCI was to allow students to decide where their money would go, student unions already have democratic procedures in place that allow students to decide which services to fund. At McMaster, for example, undergraduate students have the opportunity to vote on fees during annual general meetings, referenda and other processes.

Weiler believes that the implementation of the SCI was to question the validity of student unions as valid democracies and valid organizations. 

“It’s about time for the government to recognize us as autonomous organizations. . .What we want is to be recognized as autonomous organizations that fight for student rights, and we don’t want to have government interference into our budgets or the work that we do and we don’t want the Premier to comment on the fact that we are crazy Marxists. What we want is legislation that protects us and not hurt us,” said Weiler. 

“It’s important for these conversations to be held in a particular campus because Doug Ford is not a student in 2019. The Minister of Colleges and Universities is not a student in 2019 at Algoma University or the University of Windsor or George Brown College, so why are they making decisions for the students on these campuses?” 

 

WHAT HAPPENS NOW?

Unless the decision is successfully appealed, the fee structure for student unions will return to normal.

“Any legal requirements that existed before this case was brought are now restored,” said Century. 

The MSU, however, will not implement the results of the Court’s decision until the appeal period closes.

“Until we have the appeal period, and until we have that final decision, we do need to operate in the most financially stable way, which is assuming that those agreements are still in place,” said MSU president Josh Marando.

If the decision is upheld in Court, the results of the SCI will still be felt at universities and colleges across the province. Some Ontario student unions had to cut entire jobs and services this year as a result of SCI.

MSU general manager John McGowan pointed out that McMaster was lucky to be able to rely on reserve funds this year. However, student services have still felt the impact. With their budgets uncertain, services have had to hold off on hiring and long-term planning. 

Furthermore, the MSU dedicated resources towards implementing the SCI and educating students about the process.

“There has been quite a bit of time and energy put into creating the fees, educating students on what those fees look like, as well as making sure that we're compliant with the framework and the new tuition and ancillary fee framework,” said Marando.

If the SCI decision is upheld in court, it will mean that an unlawful directive caused harm to campus services and student unions. Chris Glover, the MPP for Spadina–Fort York and the Ontario New Democratic Party’s postsecondary critic, noted that many campus services are currently struggling financially as a result of the SCI. Glover called on Ford to reimburse student services for the losses they incurred under SCI.

“I really think that the government should step up …  Their actions were unlawful and now students are suffering, campus services are suffering, and the government should make up for this shortfall, Doug Ford should make up for this shortfall,” said Glover during a press conference. 

If the student fee structure that existed before the SCI is restored, it is unclear how services and clubs whose funds have been negatively impacted may be compensated, if at all. Both CFS-O and YFS representatives emphasized that, at the very least, the Court’s decision should be a lesson as to the importance of engaging with and protecting the democratic processes at all universities and colleges.

In February 2019, the McMaster Muslims for Peace and Justice and the Muslim Students Association hosted an event called “The Genocide of Uyghur Muslims — Talk by Uyghur Survivor”. During this event, activist Rukiye Turdush spoke about the treatment of Uyghur Muslims in Western China.

MMPJ co-presidents Batool and Elaaf, who requested to have their last names omitted from this article, explained that the event was meant to be a vehicle through which Turdush could share her experiences. Batool added that the event was also meant to raise awareness for the severe human rights abuses happening against Muslims in China.

The Turdush event came just a few months after reports were published of “re-education camps” in the Xinjiang region of north-western China, where Uyghur Muslims were being forced to abandon their religion and face abuse as detainees. In addition to reports of Mosque demolitions, the camps stand as a record of the Chinese Communist Party’s resistance against  heterodox opinions in China. 

On Feb. 13, McMaster’s Chinese Students and Scholars Association made a public statement accusing Turdush of inciting national hatred, stating that MACCSSA had contacted the Chinese consulate in Toronto about Turdush’s speech. Having anticipated the subject matter of the Turdush event, a group of Chinese students at McMaster created a group on the social media app WeChat specifically for the purpose of opposing the event. Student protestors filmed and protested against the Turdush event. Turdush herself was harassed. 

International CSSA organizations have either openly admitted or been proven to be affiliated with the Chinese Communist Party. Based on information that CSSAs at universities around the world have publicly released, the Chinese government has provided funding for individual CSSAs as incentive to populate overseas political events. For instance, the George Washington University CSSA received funding from the Chinese embassy in Washington as motivation for members to attend events welcoming President Xi Jinping to the city. 

On Sept. 22, a CSSA Evidence report was submitted to the SRA in favour of revoking the McMaster CSSA’s status. 

At this same meeting, SRA representative Simranjeet Singh delivered a presentation to the rest of the assembly called “Why We Should Revoke Club Status For The [MAC]CSSA”.

Singh’s presentation cited a 2018 report from the United States-China Economic and Security Review Commission. The report stated that CSSAs across the U.S. have governmental ties with Chinese embassies and consulates, noting that similar operations could be taking place in US-allied countries.

“The nature of the [CSSA] ties [with Chinese government] appears to involve direct subordination and political direction rather than mere affiliation or cooperation,” stated the Commission’s report.

When asked about their role in contacting the Chinese consulate following the MSA/MMPJ event, MACCSSA stated that they did not have an official relationship with the Chinese embassy. However, in a letter responding to questions from the SRA in July 2019, MACCSSA stated that they had cooperated with the Chinese embassy on issues related to cultural exchange and safety education for international students. 

The MACCSSA evidence report presented to the SRA took notice of this contradiction, alleging that the use of the word “official” was an attempt to obscure MACCSSA’s ties to the Chinese embassy. 

According to the report, MACCSSA’s failure to fully report any links outside of the MSU was in direct violation of an MSU club operating policy. The policy in question required clubs to disclose any affiliations with bodies outside of the MSU. 

As of June 19, 2019, this MSU policy now includes affiliations with political parties or governmental bodies, regardless of whether the non-MSU organization is Canadian or international.  

Singh cast MACCSSA’s act of contacting the Chinese government, which the SRA deemed to be a dangerous action, as a key detail in his decision to vote in favour of de-ratifying MACCSSA. According to Singh’s presentation to the SRA, contacting the Chinese government was an attempt by MACCSSA to intimidate students into avoiding discussions that criticized the Chinese regime. 

During the Sept. 22 SRA meeting, a Chinese student’s testimony highlighted the lack of action from MSU representatives in response to MACCSSA’s reporting of student affairs to the Chinese government. 

“If you are privileged enough to not know what it feels like to live under an authoritarian regime — one where saying something critical of the ruling party is often enough to land you and your family in prison — then please, I implore you, please listen to those who do,” said the student.

Slides from Singh’s presentation warned: “Expert testimony, including from Human Rights Watch, has confirmed that students’ safety could have been endangered if the Chinese government … got info about them attending the MSA/MMPJ event.”

“That was enough grounds for us to decide that they are a threat to free expression on campus and may be a danger to students … We cannot normalize the extremist ideologies behind the CSSA’s actions,” said Singh. 

The SRA sided with Singh, voting to de-ratify MACCSSA and cut off the club’s access to MSU resources and services. 

Over seven months after Turdush’s initial talk, she returned to McMaster on Sept. 27 in response to an invitation from the MMPJ to speak about the treatment of Uyghur Muslims in China. According to Batool, the event was a success, with over 100 spectators and no disruptions.

In late 2017, Ontario experienced its longest college labour dispute when the Ontario Public Service Employees Union went on strike.

Representatives from the student associations of multiple colleges penned an open letter to members of provincial parliament, speaking on behalf of their respective student bodies.

One of these representatives was Nicola Lau, president of the Seneca Student Federation at the time. She led 2,000 students in a protest that gained attention from media outlets such as Global News and CBC — a fact with which she introduces herself in the Facebook description of “OSAP CUT 2019”, a group she created on Sept. 7, 2019 as a means of reaching out to students severely affected by the Ontario Student Assistance Program (OSAP) cuts.

The provincial government announced their planned OSAP cuts in January 2019; this constituted the end of reduced tuition for low-income students and a change in the guidelines for OSAP grant and loan eligibility. In response, student advocacy organizations such as the Students for Ontario, March for our Education and the Ontario Student Action network hosted a march toward Queen’s Park, with student activists and MPPs expressing their intolerance for consequences stemming from OSAP cuts.

When the OSAP changes came into effect in the summer of 2019, another wave of outrage emerged across Ontario as students reported that their OSAP estimates were much lower than previous years. This led to an additional round of protests from several Ontario universities, with some taking to social media to show their frustration.

Lau, now a second year Health and Aging student at McMaster, points out that the protests have since trickled into near non-existence. She feels that the level of outrage has faded into a quiet reaction, a change that she does not believe adequately represents the struggles that students continue to experience every day as a result of the cuts.

“I think that the problem is that when Doug Ford came out last year [with the OSAP cuts], a lot of people were really angry, right? A lot of people were like, ‘Okay, I need to stand up right now. We have to do something about it.’ But quickly, all these actions and things just stopped,” said Lau.

As a student impacted by OSAP cuts herself, Lau is determined to provide a platform for students to voice their concerns. She started “OSAP CUT 2019” with the hope of raising awareness until she has gathered people for a protest similar to what she did as president of the Seneca Student Federation.

Since the beginning of the 2019-2020 school year, the Facebook group has amassed more than 100 members. Most members are students who cannot afford textbooks and school supplies or are on the verge of dropping out because they are no longer financially equipped to continue. The Facebook group has also attracted concerned parents, who are worried about their childrens’ future post-secondary experiences as the full extent of the OSAP cuts gradually become clearer.

Lau is particularly disappointed with what she perceives to be the lack of action on behalf of McMaster students and the McMaster Students Union.

“Why is McMaster, such a big school, not caring about [the OSAP cuts]? Why are we not having protests? I don’t get what they [the MSU] is doing. I don’t get what they’re doing with our student money,” said Lau.

However, Shemar Hackett, vice-president (Education) of the MSU, says that students have indeed reached out to the MSU with concerns about OSAP cuts. As a member of the Ontario Undergraduate Student Alliance (OUSA)  steering committee, he has also encouraged McMaster’s participation in OUSA’s letter writing campaign, an initiative that calls for students to write letters to Premier Ford’s office to highlight how the cuts have affected them thus far.

“Students aren’t always aware of the issues that involve them, and what they can do about it,” said Hackett, when asked about the student-led advocacy scene in McMaster.

Financial accessibility is one of Hackett’s priorities for the school year, according to his year plan. Much of this, according to Hackett, revolves around gathering as a student community and lobbying for change.

Despite the overlap between her intentions and the MSU’s, Lau questions what has really changed. She does not believe that change is happening quickly enough, she noted that students are beginning to struggle with juggling multiple part-time jobs in order to stay in school and other students having to scavenge rent money on top of their academic responsibilities.

Lau fears it might soon be too late to change the new status quo.

As a response, she has taken it upon herself, as well as the many others involved in her Facebook group, to form a voice on behalf of all those affected by the OSAP cuts. Lau hopes for the group to continue growing and, through its growth, to persuade the government to listen to them before it is too late.

In the group’s Facebook description, Lau writes, “Let’s not [let] these politicians change what will not even affect them … Let’s make a difference together.”
